Terms of Service
These Terms of Service ("Terms") govern your use of the Divvify mobile application and website at divvify.app, operated by Divvify LLC ("Divvify," "we," "our," or "us"), a Virginia limited liability company.
By creating an account or using Divvify, you agree to be bound by these Terms. If you do not agree, do not use the service.
1. Eligibility
You must be at least 18 years old to use Divvify. By using the app, you represent that you are 18 or older and have the legal capacity to enter into binding agreements.
2. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:
- Provide accurate and truthful information when creating your account
- Keep your email address current and verified
- Notify us immediately of any unauthorized use of your account
- Not share your account with others or create multiple accounts
3. What Divvify Does and Does Not Do
Divvify is a platform that helps users find co-ownership partners, negotiate terms, and manage shared assets. We provide tools for communication, financial tracking, and group coordination.
Divvify does not:
- Facilitate, process, or guarantee any financial transactions between users
- Provide legal, financial, or investment advice
- Verify the identity, creditworthiness, or legitimacy of any user
- Guarantee the accuracy of any listing or user-provided information
- Act as a party to any co-ownership agreement between users
All co-ownership agreements are made directly between users. Divvify is not responsible for the outcome of any co-ownership arrangement facilitated through the platform.
4. User Conduct
You agree not to use Divvify to:
- Post false, misleading, or fraudulent listings or information
- Harass, threaten, or harm other users
- Upload obscene, offensive, or illegal content
- Impersonate another person or entity
- Violate any applicable law or regulation
- Attempt to gain unauthorized access to the platform or other users' accounts
- Use automated tools to scrape or extract data from the platform
We reserve the right to remove content and suspend or terminate accounts that violate these Terms.
5. Listings and Co-Ownership Groups
When you create a listing or join a co-ownership group, you are responsible for the accuracy of the information you provide. You agree that:
- Listings must represent real assets you intend to co-own
- Financial terms (contribution amounts, ownership percentages) must be agreed upon honestly
- Payment records entered into Divvify are for tracking purposes only and do not constitute legally binding contracts on their own
- You are solely responsible for ensuring any co-ownership arrangement complies with applicable laws
6. Content You Post
You retain ownership of content you post on Divvify (photos, listing descriptions, messages). By posting content, you grant Divvify a non-exclusive, royalty-free license to store, display, and deliver that content as necessary to operate the platform.
You represent that you have the right to post any content you submit and that it does not violate the rights of any third party.
7. Reporting and Moderation
Divvify provides tools to report users, listings, and messages that violate these Terms. We review reports and take action at our discretion, which may include removing content, issuing warnings, or suspending accounts. We are not obligated to take any specific action on any report.
8. Disclaimers
Divvify is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components.
We make no representations about the suitability, reliability, or accuracy of any user, listing, or co-ownership arrangement on the platform.
9. Limitation of Liability
To the maximum extent permitted by law, Divvify LLC and its members, officers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the service, including but not limited to losses from co-ownership arrangements, disputes between users, or financial losses.
Our total liability to you for any claim arising from use of Divvify shall not exceed the amount you paid us in the twelve months preceding the claim (if any).
10. Indemnification
You agree to indemnify and hold harmless Divvify LLC, its members, officers, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the platform, your violation of these Terms, or your violation of any third party's rights.
11. Termination
You may delete your account at any time. We reserve the right to suspend or terminate your access to Divvify at any time, with or without notice, for any reason including violation of these Terms.
12. Governing Law
These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Virginia.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of Divvify after changes constitutes acceptance of the updated Terms.
